1. Acceptance of these terms
www.raz-vape.store (the "Site") is operated by Raz Vape Store ("we," "us" or "our"). By using the Site, creating an account or placing an order, you agree to these Terms of Service and to our Privacy Policy, Shipping Policy and Refund Policy, which are part of these terms. If you do not agree, do not use the Site.
2. Who may use the Site
You may use the Site only if you are at least 21 years old and are buying for your own personal use, not for resale. We sell only for delivery in the United States.
3. Who we are
We are an independent retailer. We are not the manufacturer of the products we sell, and brand names belong to their owners.
4. Age
Federal law prohibits selling tobacco products, including nicotine vapor products, to anyone under 21. By using the Site you confirm that you are at least 21. We may ask for proof of age, may require an adult signature or photo ID at delivery, and may refuse or cancel any order if we cannot confirm the buyer's age.
5. Following the law where you live
Laws on nicotine and vapor products differ by state and city. You are responsible for making sure you may lawfully buy, receive and use what you order. We may refuse or cancel an order we cannot lawfully fulfill.
6. Accounts
You agree to give accurate information and keep it current. You are responsible for your login and for activity under your account, and you must tell us promptly about any unauthorized use. You may not order on behalf of anyone under 21.
7. Products and pricing
We try to show products and prices accurately, but errors happen. Product images are illustrations, and product details come largely from manufacturers. We may correct errors, limit quantities, discontinue products and refuse or cancel any order, including after confirmation, for suspected fraud, a pricing or product error, or a breach of these terms.
8. Orders and payment
Your order is an offer to buy, which we accept when we ship it. Payment is processed when you order, through the methods shown at checkout, and you confirm you are authorized to use your chosen method. You authorize us to charge the full order amount, including tax and shipping.
9. Sales tax
Applicable sales tax is calculated at checkout from your shipping address. You are responsible for any tax not collected at checkout.
10. Shipping
Shipping is covered by our Shipping Policy. Risk of loss passes to you when we hand the package to the carrier. We are not responsible for delays caused by carriers, weather or other events beyond our control.
11. Returns and refunds
Returns and refunds are covered by our Refund Policy.
12. Health warnings
WARNING: This product contains nicotine. Nicotine is an addictive chemical.
Our products are for adults 21 and over. They are not for anyone who is pregnant or nursing, or who has a heart condition, high blood pressure, diabetes, asthma or another condition affected by nicotine, or an allergy to any ingredient. They have not been evaluated by the U.S. Food and Drug Administration, are not intended to diagnose, treat, cure or prevent any disease, and are not smoking cessation products. Consult your physician before use. Keep all products away from children and pets, and store batteries and devices safely. You accept the risks of buying, using and storing these products.
13. Intellectual property
The Site's content, including text, graphics and software, belongs to us or our licensors. You may not copy, distribute or reuse it without our written permission.
14. Your conduct
You agree not to use the Site unlawfully, misrepresent your age or identity, give false information when ordering, resell products bought here, scrape or interfere with the Site, or upload harmful code. We may cancel orders and close accounts that breach these terms.
15. Indemnification
You agree to indemnify and hold harmless Raz Vape Store and its owners, employees and agents from claims, losses and expenses, including reasonable attorneys' fees, arising from your use of the Site or products, your breach of these terms or any law, or any misrepresentation of your age or identity.
16. Disclaimer of warranties
THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE.
17. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING FROM THE SITE OR PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF WHAT YOU PAID US IN THE SIX MONTHS BEFORE THE CLAIM OR ONE HUNDRED DOLLARS ($100). Some places do not allow these limits, so parts of this section may not apply to you.
18. Governing law and venue
These terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute not subject to arbitration will be brought only in the state or federal courts in Broward County, Florida, and you consent to their jurisdiction.
19. Arbitration
Except for claims for injunctive or equitable relief, any dispute arising from these terms or the Site will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, held in Broward County, Florida.
YOU AND RAZ VAPE STORE MAY EACH BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE PROCEEDING.
You may opt out of arbitration within 30 days of first accepting these terms by emailing support@raz-vape.store.
20. Termination
We may suspend or end your access at any time, including for a breach of these terms or suspected fraud. Sections that by their nature should continue, including 12 and 15 through 19, survive termination.
21. Changes to these terms
We may change these terms by posting a new version here with a new date. Changes take effect when posted, and using the Site afterward means you accept them.
22. General
If any part of these terms cannot be enforced, the rest stays in effect. These terms and the policies they name are the entire agreement between you and us about the Site. You may not transfer these terms without our written consent, but we may. If we do not enforce a term, we have not waived it.
